Question- What is food safety?

Question- According to Indian law, what are the rights about food and drink?

answer- Advocate Ravi Ranjan Mishra says that every person in India has the right to eat safe and pure. For this, the Food Safety and Standards Act, 2006 has been enacted. The aim of this act is that food and drink should be safe and healthy, there should be rules on their construction and sale and people get clean food. The FSSAI Act clearly suggests that no company can sell food that can harm health. It is the responsibility of companies not to adulterate food and write the correct information on packing. If adulteration is found in a food and drink or false information is written on it, then the customer can take action. It can be complained to the FSSAI or Consumer Forum.

Question- What can I do if I get bad or adulterated food?

answer- If you get a bad, rotten or adulterated food from a hotel, restaurant, dhaba or shop, you should not be limited to getting angry. You can make an official complaint.

For this, the government has formed institutions like FSSAI (Food Safety and Standards Authority of India) and National Consumer Helpline, where you can file a complaint through online, phone or app. If found guilty after the complaint, strict action can also be taken on the shopkeeper or manufacturer like fine or cancellation of license. Therefore, being a consumer is very important to be alert and aware.

Question- How to find out whether the shop or restaurant has a FSSAI license?

answer- A 14 -digit FSSAI number is written on every shop, restaurant or packed food. This is the license number, which suggests whether the shop or restaurant is following the rules of food safety. You can check this number by putting this number in FSSAI’s website or their mobile app ‘Food Safety Connect’. If a shop or restaurant does not show this number, it is not safe to take food from there.

Question- Products claiming 100% pure can be trusted?

answer- According to FSSAI rules, no food brand can claim such a claim to mislead the consumer. Claims like ‘100% pure’ or ‘100% safe’ are not considered completely correct because any food items are prone to adulteration or dangerous bacteria. Such claims can be made only when the company has solid scientific evidence and lab tests. If a brand makes such claims without proof, then action can be taken on it.

Question- Can the customer complain if there is no expiry date?

answer- Yes, if the expiry date is not written on a food packet or it is deliberately hidden, the customer can complain about it. This is a violation of labeling norms. You can report it on FSSAI or consumer helpline.

Question- If there is no cleanliness in the restaurant, then whom should you complain?

answer- In the restaurant, if there is dirt, poor condition of kitchen or lack of hygiene, you can complain on FSSAI’s portal or app. You can also contact the local or state food safety officer. Make a photo or video for the complaint.

Question- Do online food delivery apps also come under the purview of FSSAI?

answer- Yes, online food delivery apps also come completely under FSSAI rules. Every kitchen and restaurant attached to these apps must have a FSSAI license. This is the reason that his FSSAI number is also shown along with the name of the restaurant given on the apps. This means that your food comes through safety check not only delivery, but according to the law.

Question- If someone gets food poisoning by eating, what action can be taken?

answer- If someone gets food poisoning after eating food, he can immediately complain to the FSSAI or Food Safety Department of the district with his medical report. The shopkeeper or restaurant can be fined if the investigation is found wrong, their license may be suspended. Criminal cases can also be filed in serious cases.

Question- Can only the customer complain or anyone can do it?

answer- It is not necessary to have a customer to complain. Any person, such as a person, can complain about poor food or dirt. The name and identity of the complainant is kept secret.

Question- At what levels can the consumer register their complaint and to what amount? answer- Consumer complaints can be lodged at different levels, the limit amount is as follows.

District Consumer Forum: Complaints from 0 rupees to 50 lakh rupees can be filed.

State Consumer Commission: Complaints ranging from Rs 50 lakh to Rs 2 crore are registered here.

National Consumer Commission: Complaints of more than Rs 2 crore can be filed.

If the National Commission does not get the right justice in a case, then a complaint can be made in the Supreme Court.
