Recently, the Supreme Court ordered that all the stray dogs of Delhi-NCR be caught and kept in the shelter home permanently and should not be released on the streets again. This order was given in view of rabies and serious conditions of dog bites.
Although dog bites are not limited to roads only, but also within apartments and housing societies, there are frequent conflicts about pet dogs. Incidents like dog bites or intimidation occur in lift, park or children’s play area. Sometimes this is why there is a debate or dispute between the owner of the pet and the neighbors. answer- No society can stop you from keeping pets. Guidelines of the Prevention of Cruelty to Animals Act, 1960 and Animal Welfare Board of India (AWBI) clearly say that it is your right to keep domesticated. The Supreme Court has also clarified in cases of 2020 and 2022 (eg AWBI vs. Peepal for Elimination of Strains) that it comes under Article 21 (right to life and personal freedom) of the Constitution.
Question- Can the society stop the pet dog from taking a dog to a lift, park or children’s play area?
answer- On this, the Animal Welfare Board of India (AWBI) guidelines and court decisions are absolutely clear. Society cannot prevent pet dogs from being taken to lift, park or common area. Yes, the society can make some compatible rules regarding cleanliness and security, which is the responsibility of the pet owner. Understand it in easy language in graphic below-

Question- Who will compensate for the bite or damage of the pet?
answer- If your pet dog bites someone, hurts or damages someone’s property, then his legal and financial responsibility comes directly on the owner. Under Section 291 of the Indian Justice Code (BNS) 2023, it would be considered a crime if the owner does not take the necessary precautions for controlling his pet or protecting others.
In this situation, a maximum of 6 months imprisonment, a fine of up to Rs 5000 or a sentence of both can be sentenced. Apart from this, the owner has to compensate for the treatment, compensation and property loss for the treatment of the injured person, which the victim can recover through the civil case.

Question- Can the society ban the number or breed of pets?
answer- The society cannot completely stop keeping pets directly, but can set some limitations to maintain security and system. For example, how many pets can be kept in a flat or special rules can be made about very large and aggressive breeds. However, these rules should not be arbitrary, but should be made keeping in mind the safety and convenience of all the residents.
Question- If the pet dogs raise in the society, then what should the owner take care of?
answer- Pet dog cradle is not just a matter of love and hobby, but it is also associated with it. Especially if you live in an apartment or housing society, then you have to take care of your pet care as well as the safety, cleanliness and convenience of neighbors. The same responsibility determines that no one has trouble with your pet and maintains a good atmosphere in the society.

Question- Why is the petty dog’s vaccination and health records necessary?
answer- Doing so is not only for the health of the dog, but also for the safety of the people living nearby. It is mandatory to have vaccination every year to prevent dangerous diseases like rabies. Along with this, regular health checkup keeps the dog healthy and does not pose a threat to others. The rules and laws of the society also say that it is the responsibility of the owner to keep a pet dog’s vaccination and medical record update.
Question- What to do if you have trouble because of any dog of your society?
answer- If you are getting fear, injury or discomfort with a pet dog, first talk to its owner in a calm manner. If the problem persists, then tell the Society Committee, so that they can take rules and security measures. If even after this, you can take legal help.
Question- Why is a special training or atax required for a pet dog?
answer- It is very important to give basic training to the pet dog. With this, he does not scare people in the society, protects with children and other pets and does not do unwanted acts. The right training learns to obey the dog order, it is easy to lease and the owner does not have difficulty in handling it.
Question- Are there any restrictions or rules in the society when the pet dog is ill?
answer- If the pet dog is ill or infected, the moral responsibility says that it should not be taken to the common area of the society like lift, park or children’s play area. Doing so is not only the protection of the health of neighbors and children, but is also a way to protect other pets from illness.
